Listening to the Advice of a Personal Injury Attorney

by | Apr 26, 2016 | Lawyers

After consulting with a personal injury attorney, there is no doubt that the client does have a strong case. Along with agreeing to represent the client, the attorney will also have some advice that should be followed. Here are a few examples to keep in mind.

Complete Disclosure Matters
There are times when some of the circumstances surrounding the injury can be personally embarrassing. That may prompt the client to hold back certain details, even from the personal injury attorney, but this is never a good decision. Even if a few things about the events leading up to the injury are less than flattering, go ahead and tell the attorney everything. Rest assured that the legal counsel has heard it all before and will not shock easily. In addition, the attorney can be prepared to respond if the opposing counsel decides to bring up those same facts during the course of the negotiation or the trial.

Talking About the Case
For the most part, discussing the details of the case with others is discouraged as it is all too easy to make an innocent remark that could be taken out of context. Should that remark get back to the opposing party, it could be used as a strategy to derail the claim or otherwise hinder the progress of the case. The best approach is to freely discuss all aspects with the legal counsel, but say very little to anyone else, including close friends and family.

Personal Conduct Is Important
Until the case is settled, it does pay to avoid any activities that could throw suspicion on the integrity of the plaintiff. Many people who sustain injuries will have days when they are feeling better and want to be more active. That is fine, but beware of engaging in overexertion that triggers issues later on, for example, do not help a friend load a heavy box on a day when the injured back seems to be okay. Rest assured somebody will see the activity and report it, but what will be left out is the fact that the act of friendliness meant staying in bed for two days after that.
